As part of Estate Planning, we put plans in motion that will avoid Guardianships and Conservatorships (formerly referred to as guardian of property) and the related court supervision. Guardianships are generally considered expensive and intrusive. We encourage our clients to execute a General Power of Attorney that gives their agents powers to act for them if they are unable to conduct their business and financial affairs for themselves. Revocable Living Trusts can be implemented for this purpose, as well, but they require more effort to establish and maintain.
Additionally, we encourage our clients to execute a Georgia Advance Directive for Health Care so that their health care wishes will be known should they be unable to speak for themselves due to illness or an accident. The Advance Directive allows someone to appoint an agent for health care decisions, to state his or her preferences for end of life treatment , and to name his or her choice to serve as a guardian should one ever be needed. (The Advance Directive for Health Care became effective July 1, 2007 in Georgia, and replaced Living Wills & Durable Powers of Attorney for Health Care.)
